Prostitution charges have historically been considered to be violations of state law, and with few exceptions, are not prosecuted at the federal level. In recent times, however, federal prosecutors have begun prosecuting certain prostitution offenses under certain circumstances.
18 U.S.C. § 1952, commonly referred to as the Travel Act, is a provision under Federal racketeering law, that criminalizes traveling in interstate commerce to promote, manage, establish, carry on or facilitate an unlawful activity, specifically, prostitution. These types of charges are most commonly seen in organized crime cases and in massage parlor cases. Aperson convicted of violating the Travel Act can be sentenced to up to 5 years in prison.
Federal prosecutors and federal law enforcement also prosecute prostitution cases under 18 U.S.C. § 2421, commonly known as the Mann Act. Under this law, it is illegal to knowingly transport nay individual in interstate commerce for the purpose of engaging in prostitution. A violation of the Mann Act can result in a term of imprisonment of up to 10 years.
In these types of cases in federal court, it is very common to see multiple count indictments that also contain money laundering allegations pursuant to 18 U.S.C. § 1956. Money laundering allegations are included because the government is alleging that any property or currency derived from illegal activities, such as prostitution, are subject to seizure and forfeiture.
